hello..
My friend's brother's(Alan) green card expired on 6/30/07 and he went to renew it..... But, he went to China on April which is before his green card will be renewed..... right now Alan is worrying about how to go get back to San Francisco.... what should he do????
How to enter USA without a Green Card!!!!?
I found info from a website concerning your question:
What will happen if I present an expired Green Card when I try to reenter the United States after traveling abroad, or when I obtain a new job, or when I apply for entitlement benefits?
Re-entry into the United States from abroad: To the extent possible, apply for your new Green Card before you travel and bring with you on any trip the temporary documentation you receive at the time of filing to renew your Green Card. If after traveling abroad you try to re-enter the United States with an expired Green Card, you may experience a delay during the inspection process at the port-of-entry.
I hope he brought with him his temporary proof of status document that he should have received when he reapplied before he went to China. The USCIS office usually gives the temporary proof immediately when you reapply b/c the actual green card could take up to 10-12 months to receive.
Good luck!

Reply:He should have his official receipt for the application he submitted for the new green card. That receipt is proof he's a legal permanent resident of the United States.
Reply:Sneak into Mexico, and run for the boarder.
Reply:Don't they allow slack in a situation like this?
He was in China right?...
Where was he supposed to renew it?....The American Embassy?
It isn't THAT expired....

Also he really should have thought about that before he left.
He may have to wait it out in china until his renewal comes through.

Reply:I dont understand ur question man...but if he is in China right now. he can easily renew it there. I mean there should not be any problems he can renew in china and in the US. I thought chinese people were not allowed to have green cards.
