If a wife leaves a husband after less than 2 years of marriage and takes all the money in a bank account ( about $6500.00 ) and they both signed a prenuptial agreement, does he still have to pay support? Does the fact the wife is not a USA citizen, has a green card and only came from China to the USA because she married an American affect the matter?

Reply:It all depends on what the prenup says. If she violated the terms of the prenup, she is probably not entitled to alimony. The green-card status means nothing, because the man agreed to marry her and all the legal ramifications that go along with it.
Reply:If the prenup says no support then he will not have to pay, but if it doesn't then it's possible that he will have to.
Reply:She gets whatever the prenuptual agreement says she gets in that instance...unless she successfully challenges the pre-nup in court, in which case she gets whatever the laws in that state provide or the parties agree to. She is a legal resident and is not barred from enforcing her legal rights in this country.
